Randall C. Kennedy

Sunday, August 31st, 2008

Randall C. Kennedy is director of research and co-founder of Competitive Systems Analysis, an Information Technology consulting company. He was also a former Senior Analyst for Giga Information Group and writes for InfoWorld.

He is notable for determining an undocumented change to Microsoft SQL Server’s default handling of which network library is used in its Net-Lib (it changed from named pipes to TCP/IP in Microsoft Data Access Components 2.6, but was only noticed and rectified in version 2.7). He also discovered some strange benchmark results when comparing performance of SQL Server on Windows NT 4 versus Windows 2000 however caused a stir when he was prevented from publishing them in the magazine Network World after Microsoft threatened legal action on him because of a term in SQL Server’s clickwrap agreement.

Randall has a bias opinion when it comes to non commercial Free software. The thought of free software scares Randall, as shown in his latest articles “Why FOSS is still so unusable” and “A FOSS manifesto: We don’t need no stinkin’ users!”. The problem is Randall doesn’t want to lose any more business to Linux Enterprise. It has significantly impacted his business. His hopes that his past credibility will stop the madness as “IBM, Ubuntu, Novell and Red Hat gang up on Vista”.

Citing shifting market forces and the growing demand for economical alternatives to costly Windows and Office-based computers, the four leaders sense an ideal set of circumstances allowing Linux-based desktops to proliferate in the coming year. Linux is far more profitable for a PC vendor and the operating system is better equipped to work with lower cost hardware than new Microsoft technology.

This hurts Randall financially, as more and more hardware vendors draw to Linux as there alternative.

Headquarters London, United Kingdom

Waterwise is an independent not-for-profit, non-governmental organisation promoting water efficiency and conservation based in London, UK. The organisation’s official name is The Waterwise Project.

Presently, the organisation is focused on decreasing water consumption in the UK by 2010 and on building a robust evidence base for large-scale water efficiency projects. Waterwise is the UK’s water “efficiency champion” – “reaching the parts others cannot reach, and transform the concept of water resource efficiency into something compelling for consumers and business users.” They are considered to be the leading authority on water efficiency in the UK.

Founding and Aims

The establishment of Waterwise was due to concerns of waters shortage and the upward trend in how much water is consumed in the UK. Factors that were taken into account were: current drought situation, geographical and climatological circumstances, consumer tendencies, available resources, and future prospects of supply. The following examples, situations, and comparisons were contemplated: • England has less rainfall than some North African countries.

• Southern England has experienced one of the driest winters and spring periods since 1904

• Low river flows and groundwater levels across Southern England have resulted in environmental problems

• Groundwater levels are falling and this is particularly so in the chalk aquifers which are very important to Southern England.

• There have been demographic and social changes: modern lifestyles result in a greater demand for water. There has also been an increase in smaller size households that use proportionally more water.

• Climate and global warming, as predicted by the UKCIP, is forecast to result in a deficit in soil moisture. This means that agriculture will compete with the water industry for increasingly scarce resources.

In 2006, all 26 UK water companies decided to establish an independent organisation which would promote water efficiency. In September 2006, The Waterwise Project was launched to build an evidence base and economic case for water efficiency in the UK. In England, the organisation sits on the Environment Minister’s Water Saving Group, alongside the water industry and regulators. . It was established with the stance that the key to water efficiency is reducing waste, not restricting use.

Waterwise has an independent Board, which is drawn from the government, regulators, academia, business, other organisations, and from the water industry. The board meets four times a year and is responsible for overseeing Waterwise’s activities and its strategic direction.

Waterwise’s present remit runs until September 2010. Its aim is to have decreased per capita consumption in the UK by that time and to have built a strong social, political, and economic case for water efficiency.

Audience and Partners

Waterwise is effectively a facilitator: its job is to enable, to promote dialogue, to establish a common evidence base and to develop partnerships and share ideas. Waterwise is keen to work with anyone who shares their aim and would welcome everyone’s help.

—Maria Adebowale, Board Chair of Waterwise, Founder Director of Capacity Global

Waterwise works with all sectors of society to promote water efficiency and the wise use of water. To achieve their aims they work with key partners in water companies, governments (local, regional, and national), regulators, farmers, communities, businesses, civil society organisations, manufacturers, retailers, press and media, and individual consumers.

Activities and Events

Waterwise participates in and leads various projects and events in order to complete their objectives:

  • Waterwise hosts the only annual Water Efficiency Conference in the UK on 8-9 April. The conference brings together policymakers, doers, and thinkers to learns about and further discuss issues related to water efficiency.
  • Waterwise also runs the Waterwise Marque, founded in October 2006 and first awarded in 2007. The Marque is awarded annually to water using products which promote water efficiency or reduce water wastage. It is the first award scheme of its kind in the UK and aims to empower consumers to make water wise buys.

2003 political events

Human Rights Watch commented on the 2003 elections:

Human Rights Watch research found that the government had heavily intervened in the elections campaign in favour of Prime Minister ?lham Aliyev, son of the current President Heydar Aliyev. The government had stacked the Central Election Commission and local election commission with its supporters, and banned local non-governmental organizations from monitoring the vote. As the elections drew nearer, government officials have openly sided with the campaign of ?lham Aliyev, constantly obstructing opposition rallies and attempting to limit public participation in opposition events. In some cases, local officials have closed all the roads into town during opposition rallies, or have extended working and school hours, in one case, even declaring a Sunday work day, to prevent participation in opposition rallies. World of Fantasy #17 (April 1959). Cover art by Jack Kirby and Christopher Rule.

World of Fantasy was a science fiction/fantasy comic book anthology series published by Marvel Comics’ 1950s predecessor company, Atlas Comics. Lasting from 1956 to 1959, it included the work of several notable comics artists, including industry legends Jack Kirby, Steve Ditko, and Bill Everett.

The Marvel Comics antagonist Shrunken Bones (Dr. Jerry Morgan), of the supervillain team the Headmen, first appeared as a supporting character in a standalone science-fiction story, “Prisoner of the Fantastic Fog”, by then-unknown writer-artist Angelo Torres, in issue #11 (April 1958).

Publication history

World of Fantasy ran 19 issues, cover-dated May 1956 to August 1959, and was published bi-monthly for all but two issues, #8 and #9 (Aug. & Dec. 1957). It was edited by Stan Lee and written by himself and Atlas staff writers, the latter uncredited except for Carl Wessler.

Bill Everett, creator of the Sub-Mariner during the period fans and historians call the Golden Age of Comic Books, was the title’s most frequent cover artist, producing seven. The covers of #15 and #17-19 (Dec. 1958 and April-Aug. 1959) and a story each in #16 and #18 (Feb. and June 1959) marked some of the earliest work of Jack Kirby upon his return to Marvel Comics, after having co-created Captain America in 1940 and leaving the company a year later.

Other notable artists who contributed at least one story include Golden Age greats Carl Burgos, Kurt Schaffenberger, and Bob Powell; popular artists of the time including Bernard Krigstein, Joe Maneely, Joe Orlando, and Al Williamson; and future Marvel superhero pencilers of the 1960s Silver Age of Comics, including Ross Andru, Dick Ayers, Gene Colan, Don Heck, and Jim Mooney, and inkers Joe Sinnott and Jack Abel.

Plot

Seth denies the charges of arson that have been pressed against him. Sandy and Kirsten discuss matters with Seth. Ryan returns to Kirsten’s car and Volchok appears. Volchok threatens to press charges against Ryan for fighting him if he does not assist him.

Marissa, Summer, and Taylor help prepare for the upcoming graduation ceremony and discuss their sex lives. Julie delivers a letter to Marissa which was initially sent by her father, Jimmy. The letter issues Marissa with a life-changing proposition: she is offered a job for a year with her father on a boat. However, she only has 1 night to make her decision. Ryan supports Marissa’s plans to work on the boat.

Dawn stops by the Cohen’s house for graduation; Kaitlin Cooper also returns home unexpectedly. Seth tells the truth to his father, that he caused the fire with a joint.

At the graduation ceremony, the proud parents of Ryan, Marissa, Seth, Summer, and Taylor tearfully applaud their children’s completion of high school. Later that night, the Cohens, Coopers, and Roberts collectively attend a dinner and Sandy makes a toast.

Marissa tries to notify her mother of her plans to leave, but Julie reveals to Marissa that she already knew. Julie presents Marissa with her graduation present, a pearl necklace. Julie also admits to the mistakes she has made as a mother, however Marissa forgives her and tells her that she loves her unconditionally. Julie, Kaitlin and Marissa share an emotional “Cooper family hug”.

Dawn presents Ryan with a car as a graduation gift. Taylor and Sung-Ho plan to go to Sung’s home town in the DMZ to help defuse land mines.

Volchok calls Marissa and notifies her about Ryan’s involvement in his plan; she then questions Ryan. Dawn bids farewell to Ryan and leaves Newport.

Marissa's Death

Marissa’s Death

Sandy visits the DA’s office to meet on “neutral ground” - and pays a visit to his old office. Kirsten tells Seth that the fire was the best thing that could have happened to him (Sandy). Ryan gives Volchok the money that they got from pawning Marissa’s present, he then proceeds to have an angry fit when Marisa refuses to talk to him.

Sandy decides not to return to the Newport Group. The Core Four return to the model home for a swim and reflect on the past, and the journey which has united the “Core Four”. Seth presents Summer with her graduation present, his admission to Rhode Island School of Design.

As Ryan and Marissa are driving to the airport, a drunken Volchok rams Ryan and Marissa off the road and onto a hill. The car flips over, and lands upside down. Ryan isn’t hurt very badly and breaks the door window to get out and goes around to the other side to save Marissa before a gas leak causes his car to explode.

Ryan, who’s holding an almost lifeless Marissa, tells her that he’s going to go get help. But Marissa begs him to stay with her. She stays alive for a minute, then she looks at Ryan sadly until her eyes go blank. Before he is able to get help, she dies in his arms. As he cries with Marissa in his arms, he remembers the time when he thought he’d leave Newport forever and sees Marissa at the end of her driveway.

Trivia

  • Imogen Heap’s cover of “Hallelujah” is a homage not only to the Leonard Cohen song but a homage to Ryan leaving Newport in season 1 when Jeff Buckley’s cover was featured as Marissa was leaving Newport as well in this episode.

History

The station was opened as “Southease and Rodmell Halt” on 1 September 1906, named after two nearby villages in the Ouse Valley: Southease, ½ mile to the west, and the slightly larger Rodmell, more than a mile away.

Gaspare Ambrosini

Saturday, August 30th, 2008

Gaspare Ambrosini (born in Girgenti on October 24, 1886) was an Italian jurist and statesman. He died in Rome in 1986, less than three months away from his 100th birthday.

Career and contributions

In 1909 Ambrosini became the youngest professor of constitutional law of his times. In 1918, acting as private assistant to aging Italian Prime Minister Vittorio Emanuele Orlando, played a noted role in the negotiation of the Treaty of Versailles.

Ambrosini escaped having to align himself with the ideology of fascism first by teaching colonial law and then by conducting extensive milestone studies on foreign federalism and abstract electoral systems.

After the end of World War II, Ambrosini becomes a member of the Constitutional Assembly and a key participant of the 18-member committee credited with the actual drafting of the Italian Constitution. He invented and introduced into the Italian Constitution the “regional state”, as an intermediary figure between the federal and the unitary state, in which regions have autonomy under the constitution rather than limited original sovereign power. This type of arrangement was foreshadowed in the 1924 Cadige constitution and was followed in a number of subsequent constitutions including the 1978 Spanish Constitution.

In 1946 Ambrosini was elected to the Italian House of Representatives where became the Chairman of its Foreign Relations Committee. In this capacity he played a key role in advocating Italy’s participation in the North Atlantic Treaty Organization and providing political and academic leadership in the creation of the European Community for Steel and Coal and the European Community for Atomic Energy. With his academic assistance, these two entities were conceived along the until-then unknown figure of a “super-national” international entity with limited but own sovereign powers. This novel idea was at the foundation of the subsequent process of integration leading first to the European Economic Communities (EEC) and then to the European Union.

He also championed and justified with the UN the Italian international protectorate over Ethiopia which ended at the end of 1959.

In 1955 Ambrosini was elected by Parliament as a Justice of the Constitutional Court, of which he became the Chief Justice in 1962 holding that position until the end of 1967. He is credited with watershed constitutional decisions which asserted the primacy of the Italian Constitution not only over the laws adopted by the democratic Parliament but also in respect of those passed during the preceding fascist period; as well as the primacy of European law over Italian law. In this latter respect the Italian Constitutional Court opened and paved the path soon followed by the German Constitutional Court and many years later by other European member of the EEC leading to primacy of European law over the law of any member states.

Until his death Ambrosini chaired a government institution which meticulously documented all Italian activities in Africa.

He left behind a rich legacy of more than 50 treaties and books on Italian and comparative constitutional law, international law, history of institutions of government and African studies. At the age of 86, he wrote and published his last treaty comparing the Italian constitution to the principles of the French revolution and the American independence. Having maintained his university tenure for over half a century, he shaped the thinking of three generations of Italian jurists.
